Privacy Policy

1. Our guiding privacy principles

LonRes is the controller and responsible for your personal data (collectively referred to as "LonRes", "we", "us" or "our" in this privacy policy) and is committed to upholding your privacy as a valued member, prospective member, customer or user of this or any other LonRes website. The personal data about you that we collect, process or use (‘Data’) is held securely and treated in accordance with this Policy. Whenever you give us Data, you are consenting to its collection and use as explained at the time of collection and in this Policy, including our use of ‘cookies’ (see section 7).

We operate an integrated communications programme which means we use your Data to communicate with you through several different channels, including direct mail and email (see sections 4 and 5). Our aim is to keep you up-to-date with all the latest news from LonRes, however if you feel you no longer wish to receive direct mail or email communications from us, you are able to ‘opt out’ of them individually at any time (see section 6).

2. What personal data do we collect?

If you visit the LonRes website, your Internet Protocol (‘IP’) address and other information relating to your visit will be tracked by a method called URL Rewriting where the link (URL) to any page on the site has a unique session ID appended to it (see section 7 for more details). 

If you wish to interact with LonRes, you will need to become a registered user of the site. That process will involve you providing us with Data about you such as your name, address, email address and job title. Similar and other Data such as your number of years' business experience and previous companies may be requested if, either online through LonRes or by email, or by post, in person or telephone, you order LonRes products or services.

After you first request information from the LonRes web site, book to attend a LonRes event, provide us with your business card at a LonRes event, purchase any other LonRes goods or services, or become a registered user of LonRes or a LonRes member, we will collect other Data such as when you request information or publications, sign up for conferences or other LonRes events or surveys.

When you order certain goods and services from LonRes you will be asked for further Data such as your banking details.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

3. Disclosure of information

LonRes' use of your Data for any of the purposes disclosed in this policy, or any other purposes disclosed in any separate communication to you, may involve LonRes sharing it with third party suppliers such as contractors, agents or professional advisers appointed by LonRes in providing LonRes services, facilities and products. 

These may include entities located in countries outside the European Economic area (currently the European Union and Iceland, Liechtenstein and Norway), who will be required to comply with our strict privacy requirements, and to demonstrate that they follow best practice guidelines for data protection.

In no other case, unless obliged to do so by law, will LonRes sell, rent, lease or otherwise share your personal Data with third parties, unless you have provided your specific, positive and unambiguous consent. 

4. What we use your data for

Data about you provided to LonRes will be used for the purposes described at the time of collection. It may also be used for the other purposes described in this Policy. For instance, Data will be used by LonRes to record LonRes usage patterns and your use of LonRes' other services, goods and facilities, thus helping us to administer these effectively and provide the highest possible level of service. It also helps us better understand your needs and interests.

As part of your subscription, you will receive watchlist alerts, weekly statistics, subscriber-only surveys, support notices and product updates.  If nominated as a property checker or user checker, you may also receive reminders to carry out these checks on a weekly/quarterly basis respectively.

If you are a LonRes subscriber your Data may be used to send you, by post or by email, any LonRes publications made available to LonRes members including regular monthly newsletters and updates on regional events and activities. It will also be used for LonRes administrative purposes such as subscription renewal reminders. If you are not a LonRes member your Data may be used to send you regular updates about the latest information and services available from LonRes, by post or email.

We will always require you to supply an email address when you complete a transaction on LonRes for email confirmation and administration purposes. However, when capturing your email address we may also offer you the chance to ‘opt in’ to receive other email communications. If you do not ask to be sent these communications, you will only receive email for administration purposes.

Data may also be used to send LonRes members and non-members promotional communications as described in the ’Promotional Communications’ – section 5 below. 

5. Promotional communications

Unless you have previously opted out of receiving such communications (see ‘Opting out’ - section 6), your Data will be used by LonRes for marketing, advertising and promotions (’Promotions’). These Promotions may advertise LonRes events and other LonRes services, goods and facilities, some of which are offered to you in partnership with specially selected partners of LonRes. Because of this, Data may be shared with them solely for the purpose of informing you of such LonRes events, services, goods and facilities.

Other Promotional communications may also invite you to participate in surveys or prize events sponsored by third parties. These third parties will have been specially selected by LonRes and third party Promotions will not result in your Data coming into the third party's possession unless you give separate consent to this occurring, for example if you participate in a survey or prize draw or subsequently place an order with the third party. In that event please check notices supplied by that third party for information as to how they will make use of your Data. 

Promotional communications may be made by post, facsimile, or email. In the case of email communications these will only be sent to you if you have opted into LonRes' use of email to communicate with you on these matters. 

6. Opting out 

You may at any time opt out of any future LonRes communication, digital or non-digital, Promotional or non-Promotional. If you wish to opt out of receiving postal communications please contact the LonRes Marketing Department on 020 7924 6622. If you wish to opt out of email communications please use the ‘Unsubscribe’, 'Unsubscribe from this list' or ‘Manage Your Email Subscriptions’ links provided at the bottom of each email and follow the instructions. Managing emails triggered from the system, such as 'Weekly Statistics' update email and 'Retained Agents Requirements' emails can be done in the 'My Preferences' area of LonRes. 7. Cookies

A cookie is a small piece of data that is sent from our web server to your browser when you visit LonRes. It is stored on your hard drive. There are several types of cookie that are used to keep track of information needed by a site user as they travel from page to page within a website. We use a method called URLRewriting where the link (URL) to any page on the site has a unique session identifier (session ID) appended to it. This allows LonRes to track a user's behaviour during each visit to the website (session) without the need to write a temporary cookie to their PC's hard drive.

Other types of cookie can be used to track internet activity after the user has left a website. These are normally facilitated by organisations external to the website being visited and are generally known as ‘third party’ cookies. These usually have a long lifetime with several months being quite common. They are "harvested" and "refreshed" whenever the user visits a page where the same or a similar cookie is being used. We currently have a third party cookie written from www.lonres.com as follows:

We use third party tools Google Analytics, Hotjar, Mixpanel and Marketo to measure and analyse visitor information related to our web site. For that purpose, your IP address, Internet traffic data and data on your browser type and PC are collected. We will not use any of this data to identify you personally, it is used only to monitor and improve LonRes, such as:

Keep you logged in to LonRes until you specify otherwise;
Remember the screen resolution of your computer’s monitor, so we can optimise LonRes to best fit your screen;
Store your preferences in an encrypted format – eg.e.g. your search preferences, or your email signature;
Record your site usage and the type of computer and web browser software you use in an anonymised way, so that we can gather general performance and usage data that helps us improve the site;
Remember choices you have made on the site so that we can show you the right parts again – eg.e.g. remember whether you last looked at sales or lettings, so we can show you what you last looked at next time you visit the site.

Although the browser and some third-party 'security' utilities allow you to switch them off, the Site will cease to work correctly if this happens. You may at any time exercise your right to have these cookies removed by either clearing the cookies from your browser (LonRes technical support will happily show you how to do this if you email support@lonres.com) or using the "Privacy mode" in your browser to erase them automatically, if you choose to. You should be aware that, as LonRes depends on some of these cookies to function correctly, choosing to erase these will stop the site from functioning, and you will be required to accept this notice again before proceeding. By accepting this notice, you consent to the storage and use of the cookies described above on your browsing device, and you acknowledge that you may revoke your consent at any time using the method outline above.

Internet browsers normally accept cookies by default, but it is possible to set a browser to reject cookies. If this is done it is important not to exclude the benign and useful cookies. Choose an option that rejects all third party and long-lived cookies.

LonRes's cookie policy complies with guidance issued by the Government’s Information Commissioner’s Office (ICO). 8. Third party analytics

We use third party tools Google Analytics, HotJar, Mixpanel and Marketo to analyse how users interact with our site and marketing communications. We collect, store and analyse this information for the purpose of providing the best service and improvements to all our subscribers. We do not provide the results to any Third Party.

9. Supplementary information

We may supplement your personal data with other Data about you we have received from third parties, provided that they have obtained and shared that Data with us in a manner that is compliant with all relevant laws and codes. For instance a third party may be used to verify your payment details. We may also combine Data about your purchasing habits with similar Data about you to create a personalised user profile. We can then use this to send you communications that are more likely to be of interest to you. 

10. Maintaining the information we hold about you

LonRes aims to keep the Data it holds about you accurate and up to date. If at any time you want to verify, update or amend any Data we hold about you or if you become aware of possible errors or inaccuracies in that Data, please contact dpo@lonres.com or call 020 7924 6622.

If you wish to opt out of further use of your Data for any purpose, please refer to Section 6 on ‘Opting Out.’ 

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

11. Links to third party sites

LonRes may contain links to other sites, provided as a convenience to you. You are under no obligation to use these sites, but if you choose to do so, please be aware that these sites have separate content, privacy and data collection policies. Please refer to these before interacting with the site. LonRes cannot accept responsibility for any use of your Data by these sites. 

12. Surveys

LonRes may from time to time invite you to participate in surveys. This may occur online or using other communication channels. Anonymity of individual respondents and protection of personal details will be maintained except where you have expressly granted permission to the contrary. Information gathered through surveys will be researched and compiled on an aggregated basis and results may be published on LonRes or elsewhere. Such results will not identify you. The information will be used to help us formulate our policy positions and to monitor or improve LonRes and LonRes products and services. 

13. Security

LonRes places great importance on the security of all Data associated with our members, customers, registered users of LonRes and other contacts. We have administrative, technical & physical security measures in place to protect against loss, misuse or alteration of Data under our control. Full details on LonRes security are included in the LonRes data dossier.

Unfortunately, no transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal data, we cannot warrant the absolute security of any Data you transmit to us online or to any other persons providing products or services online through LonRes. You are responsible for maintaining the security of your passwords in your possession and/or any account information in your control. 

14. Data Retention

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

Pseudoanonymisation

LonRes anonymises the personal information belonging to inactive user accounts and applicants after a grace period. All personal details are archived prior to being anonymised, then anonymised in place. Applicants still associated with a user account 6 months after the account was deactivated will be anonymised. User accounts are anonymised 12 months after the account was deactivated. A deactivation of a user account can be through either deactivation of the account's login, or through termination of a LonRes subscription by the account's organisation.

Accounts deactivated due to bad debt/continuous non-payment.

It is common for individuals in residential estate agency to leave the LonRes network and request to re-join at a later date working for a new organisation. In cases where a company has a history of bad debt or consistent payment failure, LonRes minimises the risk of recurrence by retaining the associated contacts for future cross-checking and access assessment.

15. Your Legal Rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data:

i) Request access to and obtain a copy of  your personal data.

ii) Request correction of your personal data.

iii) Request erasure of your personal data.

iv) Object to processing of your personal data.

v) Request restriction of processing your personal data.

vi) Request transfer of your personal data to another party.

vii) Right to withdraw consent.

No fee usually required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

16. Transactions

As part of our commitment to offering you a wide range of products and services, we enable you to make purchases from us or sometimes direct from a third party seller (‘Seller’). If you choose to make a transaction direct with a Seller, for instance online through LonRes or a LonRes email, we will make it clear that you are being transferred to the Seller. Offline, it will be clear from the marketing communication if you are being asked to contact the Seller direct to place an order. This is important because when you choose to order direct from the Seller, you become their customer and use of your data is then the Seller's responsibility and subject to any Privacy Policy which they may have.

If you order products or services from LonRes, an outside delivery company where relevant and a credit card processing company may be used to fulfil the order and process payment. In these instances these companies do not retain, share, store or otherwise use personally identifiable information for any other purpose.

17. LonRes business directory

If you subscribe to the LonRes Business Directory then information you submit will be available to all LonRes users. Please exercise caution before disclosing any information in these circumstances, particularly personal information about you or anybody else. For instance you, or an identified third party, may receive unsolicited Promotional communications as a result, for which LonRes cannot be responsible. 

18. Notification of changes

LonRes reserves the right to modify, alter or otherwise update this Policy at any time and users are encouraged to review this Policy from time to time. Any changes to the Policy will be highlighted on LonRes and the previous Policy will be available on LonRes for at least six months after the change has come into effect.
